I. PREAMBLE

Be it known that Joshua-James; House of Erskine…, is a living man, sovereign and independent of corporate or statutory fiction.

Suum cuique tribuere — to render to each his own — asserts the natural right of the Living Man to his liberty and estate.

Lex neminem cogit ad vana — the law compels no one to do the impossible — emphasizes that no statutory fiction can impose control over a natural, living man.

Salus populi suprema lex — the welfare of the people is the supreme law — confirms that preservation of the Living Man’s life, liberty, and Trust is of primary concern.

This Standing Protective Writ is filed preemptively, in recognition of potential acts of corporate overreach, false warrants, legal identity theft, attempted detention or kidnapping, and trespass against Trust assets and lawful estate.

Nullum tempus occurrit regi — time does not run against the king — underscores that the Living Man’s sovereign rights cannot be barred or limited by procedural delay.

Ex dolo malo non oritur actio — no action arises from fraud — emphasizes that any corporate or statutory attempt under false pretenses is void ab initio.

II. STATEMENT OF FACTS

1. The Living Man is present on the land of his residence, the Republic of Utah, and has not consented to corporate jurisdiction or statutory imposition. In pari materia — statutes or corporate acts must be interpreted in harmony with natural law; in this case, they cannot apply.

2. The Living Man maintains peaceful, lawful, and active control over all Trust assets and rights, including the AngHellic Fund Trust. Res ipsa loquitur — the facts themselves demonstrate the lawful possession and authority of the Living Man.

3. Any attempt to arrest or detain the Living Man without verified contract, lawful warrant, or proper jurisdiction constitutes an illegal act and trespass against the Trust. Fiat justitia ruat caelum — let justice be done though the heavens fall — demands enforcement of natural justice regardless of corporate or statutory opposition.

4. Historical attempts to impose corporate fiction identities or statutory authority over the Living Man are void ab initio. Actus non facit reum nisi mens sit rea — an act does not make one guilty unless there is a guilty mind — absent voluntary consent, the corporate fiction has no effect.

5. Removal of the Living Man from land jurisdiction to maritime, corporate, or statutory jurisdiction is non-consensual and unlawful. Nemo plus iuris ad alium transferre potest quam ipse habet — no one can transfer more rights than he has — corporate actors cannot transfer authority they do not possess.

III. GROUNDS FOR PREVENTIVE HABEAS CORPUS

This Petition / Writ is filed on the following grounds:

1. Cautio in futuro — preventive precaution: to avoid imminent unlawful detention.

2. No valid warrant / defective process: any attempted detention is without lawful authority. Nulla poena sine lege — no penalty without law.

3. Arrest under corporate statute without verified contract: Living Man has not voluntarily consented to corporate authority. Volenti non fit injuria — to a willing person, no injury is done — absence of consent invalidates corporate action.

4. Jurisdictional challenge — Living Man vs. Corporate Surety: the Living Man is natural, not a corporate fiction. Persona ficta non valet in veritate — a fictitious person has no power over truth.

5. Removal from land to sea jurisdiction without consent: non-consensual transfer is illegal. Territorium regit actum — the law of the territory governs the act.

6. Attempted legal identity theft: misidentification as a corporate or statutory entity is void. Fictio legis non nocet — a legal fiction does not harm.

7. Trespass against peaceful, lawful Trust: interference with Trust assets or fiduciary authority is actionable. Quod principi placuit legis habet vigorem — what pleases the prince has the force of law; in this case, the Trustee’s authority is supreme in Trust matters.

IV. RELIEF REQUESTED

Petitioner / Next Friend requests that any competent authority:

1. Immediately recognize the Living Man’s status and jurisdiction. Habeas corpus ad subjiciendum — that you have the body to subject, demanding presentation of lawful authority.

2. Require proof of lawful custody if any detention or arrest is attempted.

3. Prevent any unlawful detention, seizure, or interference by corporate actors, agents, or statutory officials. Ex injuria jus non oritur — law cannot arise from injustice.

4. Preserve and protect all Trust assets and rights of the Living Man. Acta exteriora indicant interiora — outward acts indicate the inner intention; interference demonstrates malintent.

5. Authorize any Child of God or Trustee to invoke this Writ preemptively to safeguard liberty, life, and estate. Lex est quod notamus — the law is what we record.

V. COMMAND AUTHORITY

By this Writ, any person, agent, or corporate entity who interferes with, arrests, detains, or attempts to coerce the Living Man shall be immediately required to respond before a court of competent jurisdiction. Contemptus legis — disobedience constitutes contempt.

Fiat iustitia — justice shall be done; Lex Naturalis suprema — natural law reigns supreme over corporate fiction.

VI. VERIFICATION
